Mediation is a process of negotiation conducted by an independent and NEUTRAL individual (the mediator) who FACILITATES and supports negotiations between people wishing to resolve a dispute. The Mediator represents BOTH individuals, teams or organisations, depending on the type of dispute.

The format and process of mediation depends on the type of dispute. However, all forms of mediation, from family mediation to civil, commercial and workplace mediation, have aspects in common.

Fundamentals:

  • Mediation is confidential (privileged). In other words you are not bound by the outcome of mediation until you have had the opportunity to take independent legal advice. This provides a safeguard, if legal representatives are not present in the mediation process, and allows you to think creatively and explore options you may otherwise not feel comfortable to consider.
  • Mediation is voluntary, so both of you need to agree to mediate.
